These Terms of Service (“Terms”) set out the agreement between you and Lumenary, a marketing and design studio, covering your use of this website and the engagement of our services. By browsing this site or commissioning work from us, you accept these Terms in full. If you do not agree, please discontinue use of the site and our services.

1. Services We Provide

Lumenary offers brand strategy, visual identity, web design, development, and ongoing digital marketing. The specific scope, deliverables, timeline, and pricing for each engagement are defined in a separate proposal or statement of work agreed between you and Lumenary, which forms part of these Terms.

2. Your Responsibilities

To help us deliver our best work, you agree to supply accurate information, brand assets, and feedback in a timely manner. You are responsible for securing any rights or licenses to materials you provide to us, and for keeping any account credentials associated with your project confidential.

3. Fees & Payments

Fees, deposits, and payment schedules are set out in your proposal or statement of work. Invoices are payable within the agreed terms; late payments may pause active work or incur additional charges. Unless expressly stated otherwise, deposits and completed-milestone fees are non-refundable.

4. Intellectual Property

• Ownership of final, approved deliverables transfers to you once all related invoices are paid in full.

• Working files, source code, and unused concepts remain the property of Lumenary unless separately licensed or purchased.

• Lumenary may feature completed work in its portfolio, case studies, and marketing unless a written confidentiality agreement states otherwise.

5. Acceptable Use

When using our site and services, you agree not to:

• Use our services for any unlawful, misleading, or unauthorized purpose.

• Copy, resell, or redistribute Lumenary’s designs, code, or materials without written permission.

• Attempt to disrupt, reverse engineer, or gain unauthorized access to our website or systems.

6. Limitation of Liability

To the fullest extent permitted by law, Lumenary is not liable for:

• Indirect, incidental, or consequential losses arising from your use of our work or website.

• Outcomes affected by client misuse, third-party services, or changes made after handover.

7. Termination

Either party may end an engagement in writing if the other materially breaches these Terms. On termination, you agree to pay for all work completed and expenses incurred up to that date, and any rights granted for unpaid deliverables are suspended until the balance is settled.

8. Changes to These Terms

Lumenary may revise these Terms from time to time to reflect changes in our services or legal requirements. The latest version will always be posted on this page, and continued use of our site or services after any update constitutes acceptance of the revised Terms.
